Claire Neiger Obtains Defense Trial Verdict in Case Involving an Automatic Door

Claire Neiger successfully defended a hospital in a Philadelphia major jury claim. The Plaintiff, age 38, alleged her foot got caught in the automatic door and she fell to the ground injuring her neck and arm. She underwent a cervical disc removal and claimed total disability from her employment. Plaintiff’s demand prior to trial was $500,000 and a Settlement Master evaluated the case for settlement at $350,000. At trial, Plaintiff presented the neurosurgeon that performed the operation, an economist, and a liability expert. The Plaintiff’s liability expert testified the automatic door violated ANSI standards for automatic doors. The jury found Plaintiff 60% comparatively negligent when an automatic door at a hospital closed on her foot. Because the Plaintiff’s liability exceeded the hospital’s liability, the plaintiff did not receive any recovery for her injuries.
