Eamon Merrigan Gets Hospital Dismissed from Wrongful Death Action

Plaintiffs alleged that hospital staff failed to take necessary measures to prevent the decedent from falling into a diabetic coma, then shortly thereafter, from dying of cardiac arrest.  Plaintiffs further alleged that hospital staff ceased resuscitation attempts on the decedent prematurely.  The matter was dismissed pursuant to a Motion to Dismiss in which Mr. Merrigan argued that plaintiffs failed to state any viable claims against the hospital.  Prior to dismissal, Plaintiffs’ settlement demand was $96 million.
