Plaintiff alleged that her vehicle was at a complete stop for nearly one minute when Defendant forcefully struck the rear of her vehicle causing substantial damage to the vehicle and permanent injuries to her body. On behalf of his client, Mr. Merrigan presented evidence that plaintiff had actually stopped abruptly in order to avoid an approaching police chase. Mr. Merrigan argued that the accident was unavoidable, as defendant did not have sufficient time to react to the abrupt stop by plaintiff. The jury found that defendant was not negligent.
