Matthew Moroney Receives Defense Trial Verdict in Motor Vehicle Trial

Matthew Moroney received a defense victory a claim tried in Philadelphia before Judge Annette Rizzo.  The claim arose out of a motor vehicle accident. The plaintiff originally received $26,000 at arbitration.  The defense conceded liability at trial. Plaintiff’s counsel presented the videotaped trial expert testimony of Brent Weinerman, D.O.  On direct, Dr. Weinerman testified that plaintiff’s injuries were significant and that he suffered a new herniation due to the accident.  However, Dr. Weinerman was discredited when confronted on cross-examination with his lack of knowledge regarding a prior motor vehicle accident in which plaintiff presented to the emergency room with neck and low back complaints and suffered permanent injuries according to Dr. Wienerman’s own discharge summary.  The defense also read in the testimony of Dr. Kevin Chavarria, in which Dr. Chavarria confirmed that Dr. Ficchi’s office disposed of the records from the prior accident. In addition, the defense presented testimony from Dr. Andrew Shaer, a radiologist, who opined that there was no injury, per MRI and CT scan, due to the accident at issue. The defendant testified that the impact was minimal and caused minor damage to the vehicles. After the accident, the plaintiff and defendant conversed and waited for a police officer and at no time did plaintiff have any complaints of pain. After an hour of deliberations, the jury found that the plaintiff did not sustain any injuries which were factually caused by the accident.
