Defense Verdict in Fraudulent Transfer Action Upheld on Appeal in PA Superior Court

Matthew Moroney and Warren Holland successfully defended a fraudulent transfer action and subsequent appeal.  The lawsuit was filed in Philadelphia County in an effort to re-convey real property which the plaintiff alleged was fraudulently transferred to avoid a default judgment the plaintiff obtained after an alleged slip-and-fall accident on the property.  Matthew Moroney defended the action at trial, arguing that the property was not fraudulently transferred and that the plaintiff failed to establish the necessary elements of a fraudulent transfer claim.  The trial court agreed and granted a nonsuit on one of the plaintiff’s counts and a defense verdict on the remaining count.  After the plaintiff appealed the ruling to the Superior Court, Warren Holland successfully convinced the Court to affirm the trial court’s ruling.
