GMR Senior Counsel Ann Henriksen and Associate Guy Brenner successfully obtained summary judgment, dismissing their client as a defendant in a subrogation case in Suffolk County, New York.
In this matter, the plaintiff insurer sought to recover payments it made for medical benefits, claiming that our client’s negligence was the proximate cause of an auto accident that gave rise to the claims. GMR argued that the claims were barred by a prior arbitration award, where it was found that the insurer’s driver was 100% at fault for the loss. The court found that the insurer had a full and fair opportunity to contest negligence at the arbitration and agreed that the arbitration award constituted collateral estoppel and dismissed the claims.
