Following a jury trial in Philadelphia, GMR Associate Bobby Jaffe secured a unanimous defense verdict on behalf of a regional healthcare network and one of its hospitals in a high-exposure assault and battery lawsuit.
The plaintiff alleged that six hospital security officers assaulted him as he was leaving the hospital, claiming the incident caused significant injuries to his neck, back, and shoulders that required ongoing chiropractic treatment. He sought to hold the regional healthcare network and the hospital liable for substantial damages.
At trial, Bobby demonstrated that the evidence did not support the plaintiff’s allegations. Instead, he established that the hospital’s security personnel acted reasonably, professionally, and in accordance with established policies and procedures designed to maintain a safe and secure environment for patients, visitors, and staff. The defense’s presentation, including testimony from the hospital’s security sergeant, reinforced that the security officers’ actions were appropriate under the circumstances.
After hearing all of the evidence, the Philadelphia jury unanimously rejected every claim against the regional healthcare network and its hospital, returning a complete defense verdict.
