GMR Senior Associate Tom Giardina won a Monmouth County, New Jersey, jury trial in which Plaintiff sued, alleging a permanent neck injury related to a head-on collision. Plaintiff alleged sustaining disc herniations that resulted in multiple epidural injections and physical therapy over several years. Plaintiff’s doctor recommended a cervical fusion.
GMR subpoenaed medical records that indicated prior undisclosed neck complaints and alleged no permanency related to the accident at issue. Plaintiff’s counsel argued, however, that Plaintiff never had any injections or physical therapy to his neck before the present crash. Ultimately, the jury concluded that Plaintiff did not meet his burden of proof on damages.
