GMR Senior Associate Tom Giardina won a Somerset County jury trial in which his client struck the plaintiff’s vehicle with his pick-up truck, causing significant vehicle damage. Plaintiff alleged he missed a month from work due to the accident because of permanent neck, back, right knee, and right shoulder injuries, including neck and lower back disc damage and a right knee meniscal tear. The plaintiff’s treatment consisted of physical therapy, injection, and pain medication. Tom, via subpoenaed records, discovered previous medical complaints and argued against causation. Ultimately, the jury concluded the plaintiff did not sustain a permanent injury and awarded no damages.
