GMR Partner Warren Holland won a jury trial in favor of his homeowner clients. The plaintiff was a plumber who alleged he tripped on a sidewalk defect on the defendants’ property. Plaintiff tore his Achilles tendon and underwent two surgeries to correct the condition. The trial was held on liability only.
The plaintiff alleged the defendants’ bluestone walkway violated the New York State building maintenance code because it had gaps that were too wide and deep. The defendant homeowners argued the gaps were reasonably safe. The jury ultimately sided with the homeowners and found they were not negligent.
