GMR Partner Warren Holland won a Philadelphia Jury defending a driver who fell asleep at the wheel and hit a parked vehicle, causing moderate-to-heavy damage. Although the plaintiffs claimed they were seated in the parked car when the accident happened, the defendant driver insisted the parked vehicle was unoccupied. The defendant further claimed he observed both plaintiffs come from across the street after the accident. The plaintiffs alleged neck and back injuries for two years, and one of the plaintiffs received several epidural injections in his neck and back.
At trial, Warren impeached the plaintiffs’ credibility in various ways. In addition, despite his client’s admission that he fell asleep at the wheel, the jury found Warren’s client’s testimony compelling. The jury ultimately found in favor of the defense after short deliberations.
