GMR Partner Jeff Tenthoff won a Philadelphia jury trial where his client rear-ended the plaintiff’s vehicle. Jeff stipulated to negligence and defended on factual cause and limited tort. The accident caused an alleged post-traumatic disc bulge, and the plaintiff’s counsel showed photos depicting significant property damage. The plaintiff had six months of chiropractic treatment and a lumbar epidural steroid injection and presented $35,000 of future medical expenses as economic damages.
Jeff argued that the injuries did not breach the limited tort threshold and that future economic damages were not warranted. Although the jury found factual cause of an injury, they agreed with Jeff that the plaintiff did not breach limited tort and that he did not deserve compensation for any future medical expenses.
