Matthew Moroney Obtains Jury Trial Defense Verdict Following Appeal of $27,000 Arbitration Award

Plaintiff alleged his vehicle was violently struck in the rear by the defendant’s car causing injuries to the plaintiff’s neck, back and shoulder. Orthopedic surgeon, Dr. Maxwell Stepanuk, testified that the plaintiff sustained a permanent tear of the shoulder that would require injections and possible surgery. Mr. Moroney argued that the plaintiff did not sustain any injuries as a result of the accident. He established this through the cross-examination of Dr. Stepanuk, as well as the testimony of the defense radiology expert who testified that there was no tear, just degenerative tendonosis. A Philadelphia arbitration panel awarded plaintiff $27,000. Mr. Moroney appealed the arbitration award and, after a three day trial, the jury deliberated for approximately one hour before finding that plaintiff did not sustain any injuries which were factually caused by the accident.
