Mitch Levine brings more than three decades of litigation and trial experience in civil defense in New York and New Jersey. He has taken pride in defending clients since 1992 in all aspects of general and tort liability, including premises and product liability, transportation, construction defect and “Labor Law” actions, security, false arrest and battery, Child Victims Act suits, as well as insurance- and contract-related claims, from first notice to trial. He also defends workers’ compensation claims.

Mitch believes the best outcome is often the simplest, most cost-effective, and “soonest” – risk transfer, including obtaining defense and indemnity. He previously served as house counsel to the then-second-largest janitorial and maintenance contractor, defending, coordinating, and overseeing the defense of BI suits in 19 states. He drafted many of the company’s indemnity and insurance provisions to reduce, shift, or eliminate its legal exposure.

Mitch is honored to represent several of the world’s largest retailers.  Drive past any shopping center or strip mall, and many of those familiar “big box” stores are Mitch’s clients. He understands that from his client’s perspective, he is a businessperson first and a litigator second. This means decision-making and courses of action are a joint venture focused on his client’s best interests, whether those interests are financial, structural, reputation-based, or otherwise. He encourages proactive, earnest communication, recognizing that when a client reaches out, it is because he is needed to solve a problem or mitigate a risk.

In addition to trying dozens of cases, Mitch has obtained dismissals in over a hundred more, at times recovering defense costs. He has many dozens of published decisions.  Most recently, he co-authored the Brief to the New Jersey Supreme Court in which the Justices upheld the dismissal of a national youth services organization. He also has the unique distinction of having authored articles for both the New York Law Journal and New Jersey Law Journal on premises liability and civil procedure.

Mitch previously spent two decades at a boutique defense firm, where he managed the firm’s New York office. He has consistently been named a “Super Lawyer” for the New York Metropolitan Region and is one of approximately one hundred attorneys selected for the “Defense Civil Litigation” specialty.
