GMR Partner, Eamon Merrigan, secured a defense verdict for a valued commercial transportation client in a high-stakes personal injury jury trial in Philadelphia.
Plaintiff alleged permanent, debilitating cervical and lumbar spine injuries following a collision with a commercial tractor-trailer, claiming a need for lifetime pain management and future surgery supported by testimony from a neurosurgeon.
Merrigan’s cross-examination of Plaintiff and Plaintiff’s medical expert effectively highlighted the stark contrast between pre- and post-accident objective diagnostic evidence, establishing that the alleged injuries were unsupportable. Merrigan argued that Plaintiff’s medical expert was a highly compensated “hired gun,” who was offered to fool the jury into thinking the accident had caused injuries, when it really had not.
The 12-member jury agreed with the defense, determining that the incident caused no harm to Plaintiff, and returned a defense verdict for our client.
GMR is extremely grateful for the trust our clients place in us to litigate these complex matters and look forward to Eamon Merrigan’s milestone 100th jury trial victory!
