GMR Partner Warren Holland won a New York jury trial in which Plaintiff claimed she suffered nerve damage in her right thumb after one of the defendant’s nail technicians cut her during a manicure. Although Plaintiff’s experts contended that Plaintiff sustained a radial nerve injury, Warren argued that there was no objective evidence to support their claims and introduced records from other providers casting serious doubt on the allegations.
The jury ultimately sided with the defendants and found that Plaintiff could not meet her burden to prove negligence.
