GMR Wins Ocean County, New Jersey, Verbal Threshold Pedestrian Knockdown Jury Trial

NJ Managing Partner Robert Stein successfully defended his client in a three-day jury trial before the Honorable Craig Wellerson in Ocean County Superior Court.

Plaintiff alleged she was struck by a motor vehicle operated by Stein’s client, who was making a left turn, sending Plaintiff airborne and landing in the middle of the roadway. As a result, Plaintiff claimed permanent injuries to her neck, back, hip, arms, and hands. The defense alleged comparative negligence for Plaintiff crossing the intersection in an unmarked crosswalk and disputed the severity of the impact and any findings of permanent injury.

The jury returned a “no cause” verdict based on New Jersey’s Verbal Threshold Statute (N.J.S.A 39:6A-8).
