GMR Attorney Claire Neiger obtained a defense verdict in a medical malpractice wrongful death case on behalf of a physician, a psychiatrist, a social worker, and a hospital following an 8-day medical malpractice trial in the Philadelphia County Court of Common Pleas. The case was brought by the family of a 27-year-old man who committed suicide days after being discharged from the hospital.
In addition to disputing the claims of medical and psychiatric wrongdoing, the defense contended that the hospital followed Pennsylvania law when the young man’s choice for outpatient, voluntary psychiatric care was honored over the family’s request for involuntary commitment. The jury found for the defendants despite the highly emotional and sympathetic testimony of the Plaintiff’s family.
