GMR Partner Dana Koos won a jury trial regarding alleged damages sustained in a motor vehicle collision. Dana’s client’s car rear-ended the plaintiffs’ car, so she defended the case on damages. The Plaintiffs are a husband and wife who received extensive medical treatment, alleged herniations in their lumbar and cervical spines, and sustained injuries to their right shoulders and knees.
Dana believes she won the case on her cross-examination of the plaintiffs, particularly the husband, who had two prior accidents. Dana used his deposition testimony and prior records against him, and he was not candid about his injuries in his previous accidents. Dana’s case regarding the wife was weaker as she had no known prior claims. Yet, she had similar treatment from the same facilities as her husband, so Dana questioned the legitimacy of her treatment.
The jury found unanimously for Dana’s client, the defendant driver.
