GMR Wins Summary Judgment in Middlesex County, NJ Automobile Case

GMR Partner Brandon Cohen and Associate Attorney Camryn Downes successfully prevailed on a motion for summary judgment on liability, dismissing all claims and counterclaims against their clients in a multi-defendant Middlesex, New Jersey automobile lawsuit.

Brandon and Camryn represented an owner and driver of a vehicle insured by one of the firm’s automobile insurance carriers. The Plaintiff was a passenger in the insured’s vehicle and sought damages from the insured and the owner/driver of another vehicle due to an intersection-related accident.

Brandon and Camryn focused on the New Jersey Motor Vehicle Code and established, through written discovery and deposition testimony, that the insured driver had the right of way when the co-defendant disregarded a stop sign and made a left turn, resulting in the intersectional impact. Despite Plaintiff’s and Co-Defendants’ allegations of negligence against GMR’s clients, Brandon and Camryn argued for their clients’ dismissal on liability. The Court granted summary judgment as the insured driver had the right of way, and the Co-Defendant was required to yield to all vehicular traffic on the intersecting street that was close enough to constitute an immediate hazard before entering the roadway.
