GMR Senior Counsel Keith Bursack prevailed on a motion for summary judgment related to coverage, dismissing all claims against his automobile insurance carrier in Middlesex County, New Jersey. Plaintiff claimed injuries following a motor vehicle accident and sought to recover damages from the underinsured motorist carrier for the vehicle they were occupying. After reviewing the complaint and the plaintiff’s interrogatories, Keith determined that the plaintiff did not qualify for coverage. Plaintiff disagreed with the interpretation of the policy language and would not voluntarily stipulate the carrier out. Keith then filed a motion for summary judgment that the plaintiff did not qualify for coverage under the policy due to not being a ‘covered individual’ for UM benefits. The Court agreed and dismissed the plaintiff’s case with prejudice.
