Philadelphia Defense Verdict in Traumatic Brain Injury Snow and Ice Case

Eamon Merrigan obtained two defense verdicts in a Philadelphia jury trial in which two plaintiffs alleged to have slipped and fallen on the front steps of their apartment building.  One plaintiff claimed to have exited the apartment, slipped on ice, and to have been knocked unconscious.  A second plaintiff claimed to have heard the first plaintiff scream, causing her to run out of the apartment to investigate.  The second plaintiff then slipped and fell as well.  Both plaintiffs alleged serious neck and back injuries, as well as traumatic brain injuries.  Collectively, the plaintiffs sought in excess of $1 million in economic damages.  Prior to trial, they were offered a collective six-figure settlement.  Defendants argued that plaintiffs fraudulently produced photos of icy steps, by pouring water on the steps, and allowing it to freeze.  The jury found that the plaintiffs failed to prove negligence.
