After GMR partner, Lori Miller had Plaintiff’s claims of statutory bad faith dismissed in the Eastern District of Pennsylvania, Plaintiff attempted to re-package his bad faith claims under the guise of common law bad faith. Claire Neiger instantly filed a Motion for Summary Judgment claiming that there was no new evidence and that Plaintiff’s claims were in theory already rejected by the Court’s prior decision dismissing the statutory bad faith claims. The Court agreed with Ms. Neiger and dismissed all common law bad faith claims.
