GMR Achieves Appellate Win in Uninsured Motorist Coverage Dispute

GMR Senior Associate Victoria Tarasova secured a victory in the Appellate Division, Second Department, which held that uninsured motorist (UM) coverage does not extend to injuries resulting from an assault that occurred after a motor vehicle collision when those injuries did not arise out of the ownership, maintenance, or use of the uninsured vehicle itself. Because the alleged assault constituted an independent intervening act and the vehicle merely provided the setting for the incident, the Court permanently stayed the UM arbitration.
