GMR Counsel Michael Levin Obtains Dismissal of Lawsuit Against Downingtown Area School District

GMR Of Counsel Michael Levin obtained the dismissal of a federal lawsuit brought by a former assistant principal against the Downingtown Area School District, its superintendent, assistant superintendent, and director of human resources. The plaintiff alleged that his demotion violated procedural due process under 42 U.S.C. § 1983 and the Fourteenth Amendment.

Mr. Levin played a key role in advising the School District and its administrators to ensure that the assistant principal received all process required under the Constitution. The federal court rejected the plaintiff’s claims and dismissed the complaint in its entirety, holding that the plaintiff received constitutionally sufficient notice and an opportunity to be heard before his demotion. The court found that the plaintiff was provided notice of the allegations, a Loudermill hearing, and a subsequent hearing before the school board, both with counsel present.

This decision highlights Mr. Levin’s experience in defending school districts and education officials against federal civil rights claims, constitutional due process claims, and employment-related litigation.
