GMR Partner Dana Koos secured a defense verdict in a motor vehicle accident trial involving disputed liability and alleged serious hand injuries. The jury found shared liability at 50/50, with the defendant making a left turn and the plaintiff striking the rear of our client’s vehicle.
Plaintiff claimed permanent limitations on the use of the hand affecting writing, typing, and weightlifting. However, during cross-examination, Dana established that the plaintiff stopped treatment after approximately nine months and did not seek additional medical care for nearly four years, until litigation was underway and new complaints surfaced.
After hearing all the evidence, the jury found that the plaintiff did not sustain a serious injury, barring recovery for pain and suffering under New York law.
