GMR Obtains Defense Verdict in Philadelphia Auto Jury Trial

GMR Partner Jeffrey Tenthoff secured a defense verdict in a Philadelphia jury trial involving a rear-end accident. Jeff stipulated to his client’s liability, narrowing the issue for the jury to whether the plaintiff could prove that the accident caused his alleged injuries.

The plaintiff immediately went to the emergency room after the accident, treated for several months, and received two injections to his neck to relieve pain. He also testified that he continues to have radiating neck pain with work and carrying his 8-year-old disabled daughter up and down the stairs for her therapy sessions.

Jeff was able to defuse the plaintiff’s sympathetic case by focusing on the lack of damage to the cars, the lack of recent treatment, and that the plaintiff’s treatment was encouraged by his attorney. The jury also found Jeff’s expert to be more credible than the plaintiff’s treating physician recommended by his attorney.

In the end, the jury concluded that the plaintiff did not sustain injuries caused by the accident and awarded no damages to the full-tort plaintiff.
