Senior Associate Samantha Pullman prevailed on a Westchester County, NY, Motion for Summary Judgment dismissing all claims against her client, a gutter installation company. Plaintiff alleged that he was permanently injured after falling on a dangerous condition created by the client’s negligent installation of gutters and downspouts. Samantha argued that there was no credible evidence that her client’s work was negligent or deviated from the contracted work. Although Plaintiff’s expert opined that the gutters were negligently installed and not in accordance with industry standards, the Court agreed with Samantha that these findings were purely speculative and failed to raise a triable issue of fact.
