GMR Partner Matt Moroney won a Queens County, NY jury trial in which there was no liability defense. The defendant was a commercial trucking business. The plaintiff underwent three (3) surgeries, including discectomies to her neck and back, and an arthroscopic surgery to her knee. The plaintiff had no prior injuries.
Before trial, the plaintiff demanded $950,000 to settle the case, and during closing arguments, the plaintiff’s counsel asked the jury to award $1.5 million. Matt was able to impeach the credibility of the plaintiff and the credibility of the plaintiff’s experts, who performed the surgical procedures.
The jury deliberated for about an hour and found that the plaintiff did not sustain a serious injury as defined under New York law.
