Lori Miller recently won an appeal in the Superior Court of Pennsylvania from a lower court order granting Defendant’s motion for summary judgment due to lack of causation in a premises liability death case. The Superior Court of Pennsylvania agreed with Ms. Miller and the lower court that based on the evidence submitted by Plaintiff, a jury would have no rational basis to choose Plaintiff’s theory of causation over any other theory and therefore Plaintiff has failed to produce sufficient evidence to establish a causal connection between the Defendant’s alleged defective condition and the Plaintiff’s injuries.
