GMR Partner Warren Holland won a Philadelphia jury trial before Judge Gwendolyn Bright in Philadelphia County. The plaintiff was a passenger in the defendant’s vehicle when the defendant pulled from a stop sign and was struck by an oncoming vehicle. The plaintiff allegedly suffered neck and back injuries in the accident and treated for several months.
At trial, the defendant testified he fully stopped at the stop sign, but a large van parked on the corner of the intersection blocked his view. As the defendant “inched out” to get a better view, the other vehicle struck his vehicle. Although the other car had the right of way, Mr. Holland successfully argued that the defendant acted reasonably under the circumstances and that the accident did not result from negligence. After short deliberations, the jury found in favor of the defendant.
