Partner Robert Stein secured a unanimous no-cause verdict in a multi-vehicle accident after a four-day jury trial presided over by the Honorable Christopher D. Rafano in Middlesex County, NJ.
Plaintiff settled with the co-defendant just before trial, leaving Stein’s client as the remaining defendant at trial. Plaintiff alleged multiple impacts resulting in permanent back, neck and knee injuries necessitating multi-level bilateral branch blocks under fluoroscopic guidance and a lumbar rhizotomy. Plaintiff’s operating surgeon, Wael Elkholy, M.D., who testified live at trial, recommended a future neck surgery and asserted $200,000 in outstanding medical bills. Rob was able to diffuse Dr. Elkholy’s opinion on cross-examination through missing records and using peer-reviewed journal articles.
Ultimately, the jury never needed to consider damages or the verbal threshold as Rob convinced the jury his client was not responsible for the cause of the accident.
